Below are the conditions that generally govern access to the Owner’s page, as well as the services and features offered there, without prejudice to the application of other different conditions or their modification. It is recommended to read and review these conditions periodically, as there may be modifications to the legal texts.

These General Conditions of Use are signed, on the one hand, by the Owner and, on the other hand, by you, as the User (individual or legal entity) who freely and voluntarily accesses the Website at no cost.

2. Purpose of the Website
This Website is intended for the promotion and offer of tourist destinations and products. Access to and navigation on the Website are free of charge.

4. Availability of the Website
The Owner works to improve and expand Carpe Moments, as well as its content and the services and products offered therein. Nevertheless, the Website will be presented as it is at any given time, according to availability, limitations, and other concurrent circumstances.

5. Exclusion of liability
Carpe Moments strives to ensure that the services and features of the Website are always available. However, when you access it, it will be shown according to the availability and limitations existing at that time.
Despite the Owner’s continuous efforts to protect the systems and contents included on the Website by employing the usual security standards on the Internet, it is not possible to provide full guarantees against intrusions or loss of information that may occur. The images and videos used on the Website are owned by Carpe Moments SLU or have been provided by third parties for the sole purpose of promoting products and tourist destinations. Carpe Moments also uses images with a Creative Commons license, which is always specified in the footer of each image.
Consequently, any reproduction, distribution, public communication (including making available), transformation, or any other form of exploitation—even if the sources are cited—is prohibited unless prior, express, and written consent has been obtained from the Owner or the exclusive rights holder.

8. Third-party links
8.1. Carpe Moments includes links or references to third-party websites or pages. The Owner assumes no responsibility for these or for their content or proper functioning, nor for any consequences arising from access to them.
8.2. With respect to the links published by the Owner, the User acknowledges and accepts that such links direct to external sites unrelated to both Carpe Moments and the Owner, and that the Owner does not approve or review the functions, advertising, or, in general, the content included in third-party pages, even if they are linked from Carpe Moments. Therefore, the Owner cannot guarantee that there are no computer threats, viruses, or malware on these sites, or that they do not contain illegal or inappropriate content, or other links that, in turn, lead to sites with any of the aforementioned characteristics.
8.3. The inclusion of links to third-party websites on Carpe Moments Services does not imply approval or acceptance of the linked website by the Owners. If the User decides to leave Carpe Moments’ official pages and access third-party websites, they do so at their own risk. Carpe Moments recommends reading the terms of use and privacy policies of third-party websites.

9. Indemnification
9.1. The Owner may sanction any User who fails to comply with the applicable conditions by prohibiting access to the Website, whether temporarily or permanently. The duration of the sanction will depend on the type of violation committed. Denial of access will in no case give rise to any right to compensation.
9.2. Any type of damage, harm, loss, or cost (including legal fees for attorneys and/or solicitors) arising from a breach by the User of these Conditions or any others that may apply, which causes Carpe Moments to incur liability, must be compensated by the User who caused it. This includes any third-party claims arising from such breaches.

10. Modifications
These Conditions may be modified and/or updated at any time, without prior notice. The modifications made will take effect from the time of their publication on the Website, regardless of the means or form used to do so.
The modification will only affect those Users who have accepted it after said modification.

11. Other matters
11.1. Safeguard and interpretation
If a competent Authority declares any of these provisions illegal, invalid, or unenforceable, such a declaration shall mean that the provision must be interpreted in the manner that is closest to the original intent of that provision. In any event, such a declaration with respect to one or more clauses shall not prejudice the validity of the remaining clauses.
The fact that the Owner does not strictly demand compliance with any of the terms of these Conditions at a given time shall not imply or be construed in any way as a waiver of its right to require such compliance in the future.
11.2. Language
The language applicable to these Conditions is Spanish. If versions are provided in other languages, such as English, they are only offered as a courtesy and for the User's convenience. In case of contradiction, the Spanish version shall prevail.
11.3. Legislation and jurisdiction
The relationship between the Owner and the User shall be governed by Spanish law, and any disputes or conflicts regarding these Conditions will depend on whether the user holds the status of consumer and/or user under the applicable regulations.
If the User is considered a consumer and/or user, any conflicts will be submitted to the Courts and Tribunals of the User’s place of residence. In the event that the User does not hold such status, the conflicts shall be determined by the Courts and Tribunals of Elche, Alicante (Spain).
